Terms and Privacy

1. Acceptance of Terms

By accessing or using the Uwear mobile application ("App") operated by Logiciel Uwear.ai Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To use the App, you must create an account using a valid email address and provide an upper body photo. Your username, which defaults to the first part of your email, is visible to other users and can be changed. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. User Content and Conduct

You are solely responsible for the content you upload, including photos and prompts. You agree to:

• Only upload photos of yourself or that you have explicit permission to use
• Not upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or offensive
• Not attempt to generate nudity, impersonate others, or create misleading content
• Not use the App for any unlawful purposes or to violate any laws

While we implement multiple safety filters and content moderation systems, you acknowledge that you are ultimately responsible for your usage and any content you attempt to create.

5. AI-Generated Content

All clothing try-on images generated through the App are created using artificial intelligence. We believe that generated photos of individuals should belong to those individuals, though legal frameworks vary by jurisdiction. You acknowledge that:

• AI-generated content may not be 100% accurate in reproducing clothing or personal features
• We are continuously working to improve accuracy, which is our core mission
• Generated content may be subject to various intellectual property considerations
• You may share generated content within the App

6. Credits and Payments

6.1 Credit System

• Free users receive 12 credits every Thursday at 1:00 AM EST
• Additional credits can be purchased through subscriptions or one-time payments
• Credits are used for generating content

6.3 Refund Policy

All purchases are final and non-refundable. We cannot refund credits that have been used, as each generation incurs compute costs that we must pay. Free credits are provided to allow you to test the App before purchasing.

7. Intellectual Property

The App and its original content (excluding user content and AI-generated content), features, and functionality are owned by Logiciel Uwear.ai Inc. and are protected by international copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the App and informs users of our data collection practices.

9. Account Termination

You may request deletion of your account at any time. Upon request:

• Your account will be archived for 30 days to prevent abuse and allow for reactivation
• After 30 days, your account and data will be permanently deleted
• If you log in during the archive period, your account will be reactivated
• Accounts inactive for more than one year may be deleted

10. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL LOGICIEL UWEAR.AI INC., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. DMCA Copyright Policy

We respect the intellectual property rights of others. If you believe content on the App infringes your copyright, please send a DMCA notice to support@uwear.ai with:

• Description of the copyrighted work
• Description of the infringing material and its location
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

12. Dispute Resolution

12.1 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the ADR Institute of Canada. The arbitration shall take place in Montreal, Quebec, Canada. You may opt out of arbitration within 30 days of first using the App by emailing support@uwear.ai.

12.2 Governing Law

These Terms shall be governed by the laws of Quebec, Canada, without regard to conflict of law principles. If arbitration is waived or deemed unenforceable, exclusive jurisdiction shall be in the courts of Quebec, Canada.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
