Privacy Policy

Privacy Policy for Uwear

Effective Date: August 28, 2025

1. Introduction

Logiciel Uwear.ai Inc. ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and protect your information when you use our Uwear mobile application (the "App"). By using our App, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

To provide and improve our services, we collect several types of information.

Information You Provide Directly:

  • Account Information: When you create an account, we collect your email address and a username to manage your profile and secure your access to the App.
  • Profile Photograph: To use our core virtual try-on feature, you must provide a single upper-body photograph that includes your face. The handling of this sensitive data is detailed in Section 3.
  • Generated Content: We collect and store the AI-generated images that you create and save within the App.
  • User Communications: If you contact us for support or other inquiries, we retain a record of that correspondence to assist you.

Information Collected Automatically:

  • Usage and Analytics Data: We use Google Analytics to collect general usage statistics, such as which features are most popular, session durations, and general location information (e.g., country). This data helps us understand how our users interact with the App so we can improve it. This information is processed in a way that does not directly identify you.
  • Log Data: Our servers automatically record information that your device sends when using our App, which may include your IP address, access times, and features you have used.

Information We Do Not Collect:

We deliberately do not collect certain types of information. We do not collect device-specific information like your device ID or OS version, precise GPS location data, or information from third-party social media accounts.

3. Profile Photograph and Face Data

To provide our services, we require you to upload a single upper-body photograph. This photo and the facial features it contains are considered sensitive "face data" under App Store guidelines. This section explains exactly how we collect, use, store, and share this information transparently.

3.1 What We Collect and Why We Use It

We collect one photograph of you to serve as your profile picture. We use the information contained in this photo for the following purposes, which are core to the app's functionality:

  • To create personalized virtual clothing try-on experiences.
  • To analyze body shape and proportions for accurate garment fitting.
  • To generate AI-powered fashion recommendations.
  • To provide avatar creation and customization features.

3.2 Data Storage and Retention (Your Data)

Why We Store Your Photo: We store your photograph on our secure Amazon Web Services (AWS) S3 servers. We retain this photo so that you can seamlessly use our features across multiple sessions without having to re-upload your image each time, providing a better user experience.

How Long We Store It: We retain your photograph as long as your account remains active. If your account is inactive for more than one year, your photograph and all associated data will be permanently deleted. You can request immediate deletion of your photograph and account at any time directly within the app's settings or by contacting our support team.

3.3 Data Processing and Sharing with Third Parties

Our service uses a multi-step process for generating and editing your virtual try-ons. We are clear about when data stays with us and when we use a third-party service.

Core Feature: Virtual Try-On Generation

The initial generation of your virtual try-on images is performed exclusively on our own infrastructure using our self-hosted AI models. Your original photograph is never shared with any third party for this core function.

Premium Features: AI Editing and Video Conversion

For optional, premium features like advanced AI editing or converting your try-on into a video, we use specialized third-party services.

What We Share: For these features, we send the AI-generated try-on image (which still contains your face data, but is not your original photo) to these services for processing.

Why We Share It: We share this data to provide advanced features that are not possible with our own models, such as high-resolution editing and video creation.

Our Partners' Privacy and Retention Policies:

  • Replicate: Data sent to Replicate's API for processing is automatically and permanently deleted after one hour, as stated in their data retention policy. You can review their policy here: https://replicate.com/docs/topics/predictions/data-retention
  • Google (Gemini API): For paid API services, Google does not use customer data to train its models. According to Google's usage policies, data sent to the Gemini API may be temporarily retained for up to 55 days solely for abuse and harm monitoring. 4. Data Sharing and Disclosure

We do not sell your personal data. We only share your information with trusted third-party service providers under limited circumstances, as outlined below:

  • Infrastructure and Hosting: We use Amazon Web Services (AWS) to securely host our servers and store your data, including your encrypted photograph. AWS does not have permission to access or use your personal content.
  • Payment Processing: We use RevenueCat to manage subscriptions. We do not process or store your payment card details. RevenueCat receives only the necessary transaction data to process payments and never receives your photograph or face data.
  • Analytics: We share anonymized and aggregated usage data with Google Analytics to help us understand and improve the App. This data is not linked to your personal account and does not include your photograph.
  • Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect our rights, or ensure the safety of our users.

5. Data Security

We implement industry-standard security measures to protect your information from unauthorized access, alteration, or destruction. These measures include HTTPS encryption for all data transmissions, token-based authentication, and secure hosting on our AWS infrastructure. While we strive to use commercially acceptable means to protect your personal data, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee its absolute security.

6. Your Privacy Rights and Choices

You have certain rights regarding the personal information we hold about you.

  • Access and Correction: You can access and update your username directly within the App. To request a copy of your personal data or to change your email address, please contact our support team.
  • Deletion: You can request the deletion of your account and all associated data at any time. Upon request, your account will be archived for 30 days for reactivation and abuse prevention purposes, after which it will be permanently deleted from our systems.
  • Communications Opt-Out: You can opt out of receiving promotional communications from us by contacting support.

7. International Data Transfers

Our company is based in Laval, Quebec, Canada. Your information is processed and stored in accordance with Canadian privacy laws. If you use the App from outside Canada, please be aware that your information may be transferred to, stored, and processed in Canada or other countries where our service providers, such as AWS, operate facilities.

8. Specific Regional Rights (GDPR & CCPA)

For Users in the European Economic Area (EEA): If you are an EEA resident, you have additional rights under the General Data Protection Regulation (GDPR), including the right to object to or request the restriction of the processing of your personal data. Our legal basis for processing your data is the performance of our contract with you (to provide the App's services) and our legitimate interests in improving our service.

For Users in California: If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and the right to delete it, subject to certain exceptions. We do not sell your personal information.

9. Children's Privacy

Our App is not intended for use by anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will take steps to remove that information from our servers.

10. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any material changes by posting the new policy within the App and updating the "Effective Date" at the top of this document. We encourage you to review this Privacy Policy periodically for any changes.
